General Terms and Conditions
§ 1 Agreement
The conditions outlined below, apply to the entire business connection of Noir Dark Restaurant (Company) with its clients (buyers, guest). New amendments of the conditions become an integral part of the contract, if the client does not object within two weeks. Business conditions of the client will under no circumstances become an integral part of the contract.
§ 2 Reservation
With the confirmation of the dark restaurant Noir, the reservation becomes firm and binding. Changes of reservations require written notification and have to be confirmed by Noir.
§ 3 Cancellation of Reservations up to 4 Persons
Up to 48 hours before the event free of charge – as from 48 hours before the event starts, 50% of the menu price.
§ 4 Group Reservations from 5 – 16 Persons
Reservations from 5 to 16 persons prepayment of 30 € per person will be charged.
Cancellations of group reservations between 5 – 16 persons
- up to 7 days before the beginning of the event free of charge
- up to 3 days before the beginning of the event 50% of the prepayment
- from 3 days before the beginning of the event 100% of the prepayment
§ 5 Group Reservations as from 17 Persons
Reservations from 17 persons are subject to a prepayment of € 30 per person.
Cancellation of Group Reservation as from 17 Persons:
- up to 21 days before the event begins, free of charge
- up to 14 days before the event begins 50% of the prepayment.
- 7 days and less before the event begins 100% of the prepayment
§ 6 Special Service and Bookings
When booking special services a prepayment amounting to 100% of the booked service has to be paid.
A cancellation or a withdrawal of the special services is not possible, after Noir has issued a confirmation of the booking.
§ 7 Vouchers
- Validity: The voucher only valid once it has been fully paid. The voucher is valid for duration of 12 months. A cash payback or a return of the voucher is not possible.
- Mailing costs: The costs for mailing a voucher within Austria amounts to 2,00 € within the EU € 5,00 and worldwide € 7,00.
§ 8 Liability and Traffic Safety Obligation
- Claims for damages, negligence when entering the contract and unauthorized conduct are excluded, as far as Noir or its legal representative or his assistant has not acted purposely or grossly negligent.
- No liability is taken for wardrobe.
- It is not permitted to bring along tape recorders, film- and video cameras, or dangerous objects of any kind. In case this prohibition is ignored, Noir has the right to exclude the person from the Restaurant visit and to expel the person from the house. Noir is entitled to confiscate any above mentioned objects temporarily.
Sound -, film – and video recordings – also for private purpose, are not permitted.
- The use of all sources of light (cell phones, photo cameras, cameras, LED watches, torches etc) is prohibited. In case damages because of noncompliance Noir reserves itself the right to claim damages against the person causing the damage.
- Noir takes the responsibility for traffic during the restaurant visits and takes all necessary precautions. Especially emergency exits and escape ways are provided. The Guest has to follow the instructions of the Noir staff members. In case of non-compliance or gross negligible conduct , or damages the guest is liable for the damages.
- No liability is taken for any objects or valuables brought along by the guest.
- There is the possibility to lock valuables away in steel lockers.
§ 9 Property Rights
The personnel of Noir is entitled to expel guests from the house if other guests are molested by them. Furthermore, guests can be expelled from a show if they are disturbing them considerably. Here, no claims for reimbursement of the service costs can be made. Noir reserves itself the right to launch claims against the person causing the problems.
§ 10 Change and Loss
Vouchers which have already been obtained are principally excluded from redemption. Similarly, there are no entitlements for reduced rates once the voucher has been bought.
§ 11 Cancellation of Events
In case of force majeure (e.g. fire, strike, flood, sickness etc.), Noir is entitled to cancel the event without having to pay of damages. For tickets which have already been bought, Noir reserves itself the right to define an alternative date.
In case of force majeure all payments for group reservations or special services will be reimbursed.
§ 12 Data Privacy
Noir is entitled to process and store the personal data of the clients which is necessary for carrying out the contract relationship, within the legal framework of the data privacy law (DSG 2000. All data is used confidentially.
§ 14 Court of Jurisdiction
With the purchase of an entry ticket and/or by entering the rooms of Noir, the client/guest accepts these general terms and conditions.
§ 15 Side-Agreements
Staff members of the company are not entitled to make verbal contract arrangements, verbal changes of the general terms and conditions and other verbal commitments. Amendments or deviant agreements require the written confirmation of the company, respectively the legal representative.
§ 16 Changes of these Terms and Conditions, Salvadorian
1. Noir reserves itself the right to change these terms of conditions at any time without reason. The changed conditions are sent to the client per e-mail, 2 weeks before their validity. If the client does not object to the new terms and condition within 2 weeks after receipt of the e-mail, the new terms and condition are considered to be accepted.
- If one of the provisions of these terms and conditions is not in force, all remaining provisions are not affected. The invalid provision is considered to be replaced, by a legally effective one which is in its sense and purpose nearest to the invalid provision. The same applies to possible regulation gaps.
§ 17 Validity
The general business conditions are valid as from 01.09.2009.
